TMZ is reporting that Drake is being sued over the opening monologue on “Pound Cake/Paris Morton Music 2” from his recent Nothing Was The Same album.
The album credits the opening 35 second monologue to a 1982 song “Jimmy Smith Rap” by jazz musician Jimmy Smith. However, the estate of James Oscar “Jimmy” Smith—who passed away in February 2005—claims that no one asked for permission, and therefore no permission was given. The credits go on to note, “Speech sample provided by Christian Rich and Utters.”
