Kanye West Lawsuit to Proceed

kika.ohsodjA lawsuit filed by Kim Kardashian and Kanye West over leaked footage of their marriage proposal has gotten the green light to proceed.

The ruling came as Superior Court judge Ruth Ann Kwan rejected a motion by the co-founder of YouTube Chad Hurley seeking dismissal of the case against him on constitutional grounds.

Chad was sued days after posting a two-and-a-half minute video of Kanye’s lavish proposal to Kim in October on his new video-sharing website MixBit.

The snipped of course pre-empted the official release of footage by E! Entertainment Television.

KimYe claim Chad violated a confidentiality agreement and may have infringed the rights of the producers of the reality series “Keeping Up With the Kardashians,” who filmed the proposal at San Francisco’s AT&T Park.

The lawsuit goes on to claim that Chad wasn’t invited to the event and accompanied another guest. Kim’s mother Kris Jenner wrote in a sworn statement that Chad would have been kicked out of the event if he hadn’t signed the confidentiality agreement.

Chad claims he posted his footage only after seeing pictures and congratulatory messages from celebrities online.

KimYe are seeking unspecified damages.

A trial on the case is scheduled for Nov. 17.
